Taking South Africa as a casestudy, this book examines how law is being practiced in a postcolonial country with a culturally diverse population. Here state and non-state orderings are increasingly given recognition on a national level by the legislature and judiciary underpinned by a Constitution based on fundamental values and freedoms and global normative standards. The work discusses the influence of globalism on mixed, pluralistic legal orders and presents a conceptualisation and re-evaluation of theories on legal pluralism and mixed legal systems, and the interconnectedness between these two areas of law.
